What is the name of your state? Louisiana

My fiance' and his ex have joint custody of their 2 year old little girl. The mother of the child has not let my fiance' have his daughter over his weekend. He always "babysits" for her while she works. He is supposed to have her every other weekend overnight. But he always ends up having her on some weekdays and never overnight. We do not live together, but she still is not letting him keep her overnight. She always finds an excuse not to grant visitation when he is supposed to have her. She also in the past has denied him visitation for weeks and months at a time just because he said or did something that she didn't like. He is not a violent person and has never threatened her. I have been trying to encourage him to take her like the court papers say, but she always argues about this. He thinks that he cannot go to her house and demand that he take his daughter like he is supposed to. Does she have to give his daughter to him like the papers say? He says that he cannot force her to give his daughter to him, even if she denies him visitation. Is this true?

If he has court ordered visitation -- a judge/magistrate ordered it -- then she must give him the child then. If not and he attempts to get his daughter then that is a violation of a court order and contempt. Mom does not dictate when there is a court order in place. He cannot physically force her to give his daughter to him. But he can march back into court and file contempt if he attempts to exercise his visitation (shows up where he is supposed to when he is supposed to to get his daughter and mom refuses to give him the child).

FYI - It's not "babysitting" when the child is yours. ;)
