What is the name of your state?Maryland (address of record) but have orders to Guam.
I was just told that I am going to Guam next year. I am in the process of petitioning the courts for CS in Maryland for our 12 year old son. His father and I were never married and I am tired of shouldering the financial responsibility on my own. I have never been on welfare and I am active duty Navy.
His father is the classic deadbeat daddy and is currently hiding from another woman with whom he has a child with. He was not tricked into being a father and was there for the birth and has openly acknowledged this child as his. He has not attempted to make contact with my son since his birthday last December. My son is at the point now that he does not even ask about his father anymore :( I have lived in Maryland where our son was born and never moved but his father has moved to Indiana.
I have never prevented his father from spending any time with him and their time spent together I pushed for and had to provide transportation for my son to and from.
My son is rather excited about moving to Guam and I want everything to run as smoothly as possible with the move.
My fear is that once his family hears about my orders will they(my son's father and his mother) have any legal rights to prevent me and my son from going overseas?
If I cannot find his father to notify him of the move can this come back to bite me later?
How will my orders affect my case? Like I said I just filled out the CS forms to get the process started last week.

Edit to add info: I plan on coming back at least twice a year to visit my family in Maryland. My mother is the one listed on my family care plan to take my son in the case of my deployment and my family is the only one my son really knows and that I feel comfortable with taking him. His father has a hard time taking care of himself much less taking care of a child. His (my son's father) mother is a bit of a busybody and I wonder what rights she has regarding this if any. Can she petition the courts for me to change my family care plan so my son has to go to her?

You know....if you don't need the child support it may be wiser to dismiss your case now before it goes any further. That does tend to be something that sparks a deadbeat parent into filing for visitation rights....which could make your move stickier.

Also, if you don't already have a passport for your child and dad is listed on the birth certificate you have an added complication....because normally dad's permission/signature is also required to get a passport.

No, grandma can't challenge your family care plan....but dad could....and grandma might be likely to push him into it.

All in all, your odds of winning permission to relocate with your child to Guam would be pretty good considering the overall circumstances. However it would be wise to get your ducks in a row as soon as possible.

I am pressing for CS because I do need the money. And yes the fathers name is on the BC. When this gets to court would abandonment by his father come into play with a passport? I don't PCS for another 9 months.
