What is the name of your state (only U.S. law)? California
A little background. My ex and I divorced in Dec. He moved to the east coast in April. Court order says "visitation as agreed upon by both parents." We don't have a long-distance parenting plan, mostly because with his schedule (military), he doesn't know long term when he is going to be home etc. Also because I am planning on moving to the midwest, so the kids will be closer to their dad.
I am trying to negotiate visitation with my ex regarding our children ages 5-12. He wants to fly them out for Christmas, which is going to cost about 2200. I offered to pay 100/child but he would have to be responsible for the rest. (I am trying to save up for a house when we move next summer.) I also offered that the kids have a "fall break" from school. If he wants to come out to visit them then, I will pay for his hotel, he just needs to pay for his ticket and car rental. I think I'm being pretty reasonable and accomodating.
If he decides to go back to court to get an order saying I need to pay half, with his reasoning being "the military gave me orders, I didn't have a choice." I know for a fact and can get proof from Bupers that he was offered orders to stay here in California, and he took the orders back east. Would that be grounds for him having to pay expenses?
