my step-children, ages 10 and 13 yrs. have a half-sibling by their mother. their half-sister will be 3 yrs. old in january. the father, my husband, has sole custody with bio mom having supervised visits which she is failing to show up for. the children are distressed not because they want to see their bio mom, but because they want to see their half-sibling.
my step-daughter is in therapy at this time and she told her therapist that she wanted me and my husband to go to court and "tell the judge to make mom bring Magan to see us". the therapist also said my step-daughter is "very sad and angry" that her mother is cheating her out of seeing her half-sister. it has been 5 months since she's seen her. a friend of mine told me that the judge wouldn't dare entertain such an idea.
i was thinking about enlisting an attorney to represent the children themselves and let the children petition the court. i know it sounds far-fetched, but does anyone out there remeber some years back the true story of a young boy who petitioned the court to terminate his parents parental rights? he won. i know that is not a clear indicator of my situation and, in fact, is different from my situation; however, just because it's never been done before doesn't mean it can't be done, does it? that little boy who managed to get his parent's parental rights terminated was the first such case to my knowledge.
what do you guys out there think? should my step-daughter just be expected to suck it up and deal with it only because her bio mom is too lazy and spiteful to come see her and her brother?
