Visitation out of state

I live in CA. I currently have primary custody of my son.

My ex-wife has moved to CT with her new husband, and has lived there for over a year now.

She is requesting that my son come spend the next summer out in CT with her.

Is there anything I should do to protect myself and my son legally to go out of state to her residence? Or should I just say no?

Im not sure if by letting him leave, that she might have legal rights in her state to keep him there and not return him home.

What does your visitation order say as to her rights to summer visits?

well as far as the court paper work. It says that the Respondent shall not remove the minor child or children of the parties from the state of California.

I don't want her to not see her son now that she lives out of state, but I also do not trust her and with very good reason.

Other than that the child visitation just says "reasonable". Including current address notifcation, emergency contact, and unresitricted phone access for each party.

I also have not sued her for child support, so I am currently not collecting. She has very little money, so another concern would be the welfare of my son while he is visiting with her.

Then tell her she may have as much time in the summer with him as she wants however it will be in California and not in Ct. Remember, it was her choice to move.

FOLLOW the court order to the letter. Nothing more and certainly nothing less.

Absolutely. And when she whines about it, tell her she can come to CA to file for a visitation modification, because that is where jurisdiction is. Also, you should really file for support, whether she has a lot of money or not. She is legally obligated to support her child too, even if the amount is minimal.
