Visitation Overseas

What is the name of your state (only U.S. law)? CA

My son is coming to visit me in Japan. The visitation order only specifically states 2 weeks in Japan but I'd like to take him to some other countries in the area. Do I need my ex-spouses permission to take him outside Japan? If she doesn't agree, do I have to go back to court to get the order ammended?

I know that you would like to travel around the area with him, but different countries have different rules regarding having parental permission to cross borders. You could run into problems if you don't have mom's written permission, and a US judge's court order may not be sufficient for some countries. What you really need to do is some research into crossing back and forth amongst the countries you want to visit.

Yea, I realize that traveling to other countries could be very difficult without Mom's written permission. I've had friends travel around lately and they've had no problems.

Here's a more specific question - and my real concern:

Can I get into trouble with the U.S. family courts if I do take my son out of Japan, and travel to other countries, without an order specifically stating so and without my wife's okay (she's not okay with it)? I don't want to ever be accused of violating a court order especially when that could affect my future visitation?

It depends where you intend to travel and the safety of the country to a great extent.

If mom is against it, maybe it's a good idea NOT to do it....you're only going to piss her off and get into an adversarial mood with you. That's not in your kid's best interests. This isn't a life or death matter, pick your battles.

True, there is PLENTY to see in Japan over a two week period.

I grew up with constantly feuding parents - it was hard to deal with! I think parents should go out of their way to avoid fighting if it's not over something truly important. I can understand why mom would be nervous about kiddo traveling all over the south pacific without her; him being in japan for 2 weeks is probably hard enough. If you respect her wishes this time, maybe next visit she'll be willing to allow it.
