i am from ohio, been divorced for 10 years. my ex recently got married. sunday at 6pm when dropping my son off, my ex and his wife anounced(after walking right into my home)that my 12 year old wants to live with them and they have retained a attorney. my ex has visitation from fri at 6pm till sun at 6pm, he works second shift and can not pick my son up himself until sat morn. i have been allowing step mom to pick up until now, i have said no. i received a letter from their atty. saying there is no reason she cant pick my son up. my son would be with her not his father until the morning, i feel he has visitation, not her. any advice????????

How serious is he about pushing for a change in custody ? and what does your son think about it when he is at home with you ?

The problem is that if the environment is 'stable' a judge will allow the step mom to pick up the child and 'may' feel you are unreasonable if you deny it. If they are going to fill for custody then you need to tread carefully and not give them any ammo..
