My husband has a 14 year old daughter. They were divorce 10 years ago and in his divorce papers it states that he has joint legal custody and gets her every other weekend and two weeks out of the summer. They never really went by those divorce papers. She came whenever and , sometimes on his weekend sometimes during the week and during the summer she sometimes would stay with me because her mom would work and her mom would pick her up after work.. The Cp says that the papers were done when she was 4 and not 14. That sounds so stupid doesn't it.. LOL Well now that she is older she doesn't come as much anymore. So now my husband has told her mom the Cp, that he wants to get her on his weekend and the CP says the child doesn't want to come and she isn't going to make her. Well friday tommorrow will be his weekend and he wants to go get her. What can he do legally? Can he legally go and make her come? What should we do if they refuse or they are not their? I just want to make sure all our ducks are in a row....

If you have a CO then your husband should try to pick her up. If mom refuses or is not there, she is in contempt. It doesn' t matter if she likes the co or not, if she doesn't, she should have it modified.

GA is one of those weird states. I believe, at 14, a child can choose unilaterally which parent to live with, but I don't think that a child can choose whether or not to visit the other parent.

Hubby needs a lawyer.
