What is the name of your state? Fla. My question is kinda difficult. I have joint custody of our two minor children and my exs is not compying with the visitation schedule. The last time he seen our kids was on April 5th and only for maybe 30 minutes his choice. The time he seen them before that was before Thanksgiving and was basiclly forsed into that he wanted to see me but not the kids. Is there anything I can Do to either force him to spend time with his kids or Relinquish his rights to them? This getting really hard on my kids my son is 11 and his father didn't call him or come by for his birthday. my daughter is 8. He gave the kids his cell number to call him then not even a week later the phone was cut off or something cause they could never get him to answer. What should I do? Can I do?

No, you can't do either. Visitation is not legally an obligation and unless he is willing to terminate his rights and you have a husband that is willing to adopt the kids you will not be able to terminate his rights.

All you can try to do is encourage the relationship.

So there is nothing I can Do? This is hurting my kids emotionaly and there school work suffers when they do seen him and he makes promises to them that he cant keep. I feel that all this is gowing to harm them emotionally as they become adults.

You can try to get them into counseling for it but legally, no there is nothing you can do.

What about filing for soul custody on the grounds that he does see his kids or have anything to do with them and is not concerned with any disicions made on there behalf? He is supposed to have them everyother weekend and two weeks at christmas and every other holiday. He is also supposed to share costs of health care with me and he doesn't. He is also almost $10,000.00 in the rear on child support.

You could file for sole custody.

Just curious, have you filed for contempt for non-payment of support?

Here in Fla the department of revinue handles the child support he has a income deduction order on him now. But recently the payments are not every week but bi-weekly and what makes me think he may have quit his job and on the way to getting further behind.

You DO realize that many employers don't HAVE a every week pay structure? Most of us DO only get paid every OTHER week, or ONLY on the 15th and 31st? That most companies find it too costly to generate pay on a weekly basis? And I only get my commissions one time each month, for example. There may not even BE anything to garnish on a weekly basis.
