What is the name of your state (only U.S. law)? ND

I have a question and hope that its not misunderstood. Currently my visitation is set up to be every other weekend and then the two months of summer (June/July). My current job requires me to work nights/overnights/weekends so when I do have my kids they spend all of their time at either a daycare or with a friend.

My question is this, Is my visitation required or is it optional on my part? Like I said, please dont misunderstand my question. I see my kids as much as I can but it seems sensless for me to take them on weekends and all that time during the summer when all its doing is costing me money I dont have... between child support and the cost of daycare I can barely make ends meet plus I never see them... I'm lucky to spend an hour each day with them. I call them every day and any chance I get (or am allowed by my x-wife) I will pick them up when I'm in their town.

Senior Member
Visitation is not required, it is optional on your part. If you fail to exercise visitation over a stretch of time, the other party can move to limit your visitation time by court order since you're not using it and they may be successful.

If there is a different time-share arrangement that might work better, you might make a motion to modify visitation to a different schedule.
