South Dakota. A co-worker and I had a child. I pay child support and we cannot agree on anything. we've tried mediation and it's gotten to the point where we can't be in the same room with one another. I would like to see my son on reasonable terms but she always wants to be present. At this point I’d just like to spend my lunches with my son while he is at child care. Can she deny me visitation unless it's to her liking? I’m to the point where I either want to see my son on the above terms or just sign off my rights to get her nonsense out of my life. What are my options and what can I do to get to see my son without her around or to sign off my rights? Thank you for your time and have a great day!

You have neither option. You have a child, you can't just sign him away and if you were any sort of decent person, you wouldn't even be considering it. You have the right to file in court and get court ordered visitation which she must comply with.

Well, if you haven't gotten a DNA test, you can't even be sure of that, can you?
