I live in Texas. Can someone please tell me if visitation with a parent who has been incarcerated for several years can be stopped if that parent is about to be released? Does incarceration have any influence on the judge? And if a motion to modify visitation is filed to prevent visitation with the soon to be released incarcerated parent while this person is still in prison, does this person have to be served notice, or can the notice simply be mailed to her in care of the warden? Thanks for the advice.

You need to file for a visitation modification. Unless the confiction was based on some harm he/she could cause the children he/she will still be allowed visitation. Most probably the most you can get is supervised visitation for unless it's really really and I stress really bad the judges try to keep contact with parents.
