When I filed bankruptcy in 1995 (Arizona), my attorney advised me to voluntarily surrender one of my two vehicles prior to filing the paperwork with the courts, which I did. In my petition it states that I voluntarily surrendered this vehicle and lists the dealership which it was purchased from and subsequently surrendered to. Was this debt discharged in my bankruptcy even if it was not listed in the debtor list? Please help, as this item (as well as others listed in my petion) still reflect as open items on my credit report. Thank you.

voluntary surrender

here in florida when you voluntarily repo a car the bank that held the loan sends it to auction. if they recieve the payoff on the loan you are no longer responsible but if they recieve less you are responsible to pay the balance. it should show up on your credit report as a voluntary repo but i don't believe it is discharged with your bankruptcy.
