My husband was just notified by his Personnel Office that his wages are being attached for a personal tax that I owe. My husband contacted the law office and asked why they were attaching his wages instead of mine and they said it was "easier" and that it was perfectly legal. Is this legal? Can't I request that my wages be attached instead of my husband's. Wouldn't they have to comply to my request? I'm worried that they will try to attach my wages for the same tax year and I won't be able to prove that they've been paid.

Whether the attachment is legal or not and whether, even if it is legal, there is something you can do about it, depends on what state you are in (community property or otherwise), whether you filed a joint return for the year in question, and whether you had any connection to the income, also if there was proper notice from the IRS.
