I have been getting numerous phone calls at work (after I asked them not to call me at work) regarding a collection on a Capital One Credit Card. My credit report states two things.... Profit and Loss Writeoff and Charged Off as Bad Debt. They are threatening to garnish my wages which I am told is illegal in Pennsylvania. They even said at one point that they would take my entire paycheck and there's nothing I can do about it. I have the collection agency and contacts. They have faxed proof of employment papers to my place of employment twice in the last couple of months.

I am just trying to find out as much as I can about the law on this type of thing so that when they call me AGAIN, I can be more prepared.

PLEASE HELP!!!!!! I am going to have a nervous breakdown.

First of all..

Never talk with a collection agency on the phone, unless you're recording the conversation. (Check the laws in PA to see if you have to tell them the call is being recorded).

Now, get their address and send them a debt validation letter along with instructions that all further contact is to be in writing and that they are not to call you at work. Send it Certified Mail, Return Receipt Requested.

IF...big if...they sue you and win a judgement against you, and if its legal in PA, they may be able to garnishee your wages, but they cannot take "all your paycheck".
