We are from Alabama and were involved in an auto accident in Missippi. The other driver ran a stop sign and pulled out in front of on comming traffic. The other parties insurance offered the value from a CCC report. This report was low and my auto was rated as average condition. I requested the average value of Kelly Blue Book, NADA and Edmunds with a rating of good condition. I also requested lost interested because this auto was financed at a low interest rate which was not available when the auto had to be replaced. It has been over eight months since the accident and the matter has been turned over to a lawyer for better than six months.
My questions; Will the CCC value standup in court? Am I out of line requesting the average value from three different sources? This auto was low milage and clean as a pin. Will I have to accept the rating given by the adjuster because "everybody's car is average"? The insurance company says they have never been held responsible for lost interest due to an accident involving an auto that was financed at low interest. Will I have to accept this loss?
My wife has medical bills that have also not been paid by the other parties insurance. She is no longer having treatments because the doctor says there is nothing more that can be done and the minor pain may never go away.
My lawyer is not as aggressive as I would like but maybe I will just have to live with it. How long should it take to settle a matter like this? I dont feel that I am requesting anymore than to cover losses but I am about tho the point that I would like to see the insurance company pay dearly to someone!! It seems like a waiting game to see how long I can hold-out!!
