My husband works at Wal-Mart In Saginaw tx, there was a bonus given out to employees, and around this exact time they put 935 in his account( around 400 of this is normal paycheck). We thought oh yay he got the bonus. Well next paycheck comes around and it happens again...so we report it to personnel. They tell him it was indeed a mistake and it will be investigated, and to keep the money. Personell told us they will take it out of his checks in increments when the investigation is over. So we spent it on medical bills. Months go by and we were informed a week ago that the money has to be paid by Dec 15, and they do not accept payments...wth are we supposed to do, and can they do this?

They legally cannot take it out of your husband's pay without his written permission. However, they may legally fire him for refusing to pay it back when they want him to, and to sue him for it. If they sue him they will probably win.
