I now live in Ga. Five years ago I married in va. 3 months afther we seperated.I moved here now I wish to get a divorce but can't find her how can I file with out her.

My response:

You don't have to find her.

Your Georgia attorney will file a Petition for Publication of Petition for Dissolution. Once that Petition is granted by the court in Georgia, your attorney will have the Petition for Dissolution published in a Virginia newspaper of general circulation nearest to her last known address.

Then, it's up to her to see, or obtain notice of, the publication. If she does, it's up to her to do something about responding to the Petition. If she doesn't see the publication, you'll eventually obtain your divorce by default.

On the other side of the coin, she may have already done this herself, and you're divorced without even knowing it. Therefore, it would be financially prudent for you to hire a Virginia "Attorney Services" company to search the local Virginia court records to see if a Decree has already been granted. If so, have them send you a "Certified Copy" (not just a regular copy) of the Decree.
