What is the name of your state?What is the name of your state? Texas - Grandmother died - left a will but had nothing left but personal property and a checking account in which my sister and I were on the account with right of survivorship. A cousin is the executor and my sister the co-executor of the will. It is our understanding that the will does not have to be probated since there is no property with deeds and such. All the personal property has been divided and we even divided what was left in the checking account after all bills and expences were paid. We had taken care of her on a daily basis for the last six years. Now the executor (cousin who continuously said this is none of her business) has decided that we need to do an accountability on where every penny was spent and on what for the last 6 years. Is this something a probate court would have us do? Thanks

What assets is she wanting an accounting of?

We tried to show all involved 6 years ago how much money there was and what her care was costing, the reply we got was her finances are none of our business so we did not send the info any more. She has now called requesting this accounting and says it goes hand in hand with the probating of the will. We told her she did not need to spend the money to probate due to it would serve no purpose. She is using the probate issue as a reason she needs this accountability so that if we all agree to where the money went we can sign off on that and she wont probate but If we dont do the accountability she is going to probate which will make us prove accountability. If she probates will the probate court request this? If so we need to get it done , if not she can go jump.

I don't see how a probate court could order you to account for YOUR money.

Don't talk to her about this anymore.

You don't owe her an accounting--the money passes outside of probate under the concept of right of survivorship and automatically becomes the property of the joint account co-owner. So go tell her to look up right of survivorship in the dictionary.
