Our Contract Indicates that the seller needs to notify us 10 days prior to the closing date of the date AND time. I have called him several times for this info and although I knew the date was the 19th (4 days from today) I just got the time today. Is this a Loop to get out of the Contract? I am also afraid that because he has delayed for so long that our Agent may not be available due to other closings.

Also, his reason for not returning my several messages on this was because he thought we were going with his slimy lender and his slimy lender mentioned we would not be financially ready, BUT our contract indicates that on the 19th we will sit down (either way) and write a new contract a/o discuss leasing options.

We are ready to stop payment on the earnest check and walk to our nearest attorney, what do you suggest? Thank you!!!

I spoke to an Attorney

Hi! Just an FYI, I spoke to an Attouney and he recommended just attempting to ask for the earnest money and to get out of the contract. So we called, mentioned that we contacted the attorney and that was enough to get them to sign a release. I think they new they were got doing bad business, or maybe we were just lucky. Either way, I am SO glad to be out!!!
