What is the name of your state? Fl
My husband and I filed chapter 7 in Pa. in 8-05, discharged and closed 5-06. We surrendered our home. Yesterday we got a citation from Pa. magistrate for failing to maintain property. We have 10 days to respond and appear before him or a warrant will be issued. I am not sure what to do. I have previously spoken to someone from our old city and explained the situation. He said our names are still on the deed and therefore we are responsible. We have tried contacting our attorney and he never calls back. I can't afford to fly back to Pa. The mortgage company has already started foreclosure process. What should I do?

Notify the mortgage company if you haven't already. It's really THEIR headache right now. Find out if you can quit-claim the deed to the mortgage company and get your names off of it.
