I live in MN. I was verbally told when we purchased our home that the driveway was shared. At that time, we had no problem with the situation. Sharing the driveway has turned out to be a nightmare. (The house next door has been rented for the last year by a large group of college men) Anyway, I have located a copy of the original easement signed in 1995 by the previous owners of both houses. It states that the easement is to allow our neighbors accessibility to their garage - which has since been removed. Our neighbors are now selling their house, and I have stated that I would like us to sign an agreement to void the past easement. At this time they don't want to. My question is #1 Do you feel we have a good chance of winning is this goes to court? And second, Will a court case stall the selling of their home?
