I currently live in PA. My ex moved us here from NY. He now lives with the girl he had an affair with back in NY with two of her three children. I am wanting to move to CO with my boyfriend and my four children. He does see them on weekends although I have to force them to go. He calls them names and occasionaly hits them. Now that i told him I want to move he has filed for custoday and wants to make it that I cant leave the state. He does live 100 miles away now. My question is do I have a chance of winning the right to move and can he win custody of my children? I am very afraid. I love my kids with all my heart. Please help.
 


Speaking logically, not legally, if he has already moved out of the state in which the case was filed (assuming the current custody was established in PA)...he cannot force you to stay in PA while having himself moved to NY.

For him to be awarded custody, he would have to prove that you are unfit and children are endangered. Unless he can do that, I would just double check with the office where the order was filed what steps you need to take to lawfully move out of state.
