Want to pay back a judgement

My husband has a judgement against him for 10,000, This was money he borrowed from someone for a business loan. He borrowed it in 1996. Because of unforseen circumstances and an illness that he now has the debt has gone unpaid. A year ago they garnished about 850.00 from his bank account and just in March of 2004 they garnished about another 400.00. He wants to pay back this judgement. He has the opportunity to pay this loan back but is only able to pay back 9,000. This person had gotten an attorney to collect the debt. Would he be able to contact this person by letter or does he have to go through the lawyer. He wants to send a letter saying that this is the amount that he could pay and wants her to agree by signing this letter that before he sends payment he wants all judgements showing this debt to be cleared and all three credit reports to clear the judgement. and when she signs it he will then send payment.

How do you go about clearing a judgement? Is there a form letter that he could send, and if so where could he get it? Does he have to contact the courts?

Please help he wants to clear this asap.

He can write to either the person or the attorney, but the person is going to tell the attorney about this so it would save time to just deal with the attorney directly.

Husband can not put pre-conditions before he makes his payment--what your husband is asking for can all be done only AFTER he makes the payment. He will receive a receipt and probably a letter from the attorney showing that the debt has been paid in full, and then the attorney will report either to the company where the debt originated or to the credit agencies that the amount has been paid in full, or your husband can contact the credit agencies himself and they can keep him informed about the status of his credit to see whether this has been corrected.
