What is the name of your state (only U.S. law)? Sc

I am currently in SC. My X is in PA. I am active duty and will be relocating soon, after a year tour overseas.

My problem is-- My X will only let me see my kids on her terms or not at all, and most time she wont even answer the phone so I may speak with them.

There is currently no legal custody either way, although I do pay child support.
I am wanting to know what I should do... I want to be able to have my sons for their summer breaks, and maybe every other Christmas break, with me, in my home. That's all.

Now, do I get a lawyer and go for legal visitation, or for Partial Custody so that they can stay in my home for those weeks, or months?

Any ideas, suggestions?

File for joint legal custody, and visitation. How old are the kids? How often have you seen them since you were divorced?

They are 9 and 7.

I have seen them once since the divorce, a MONTH over this past summer. That is all she would let me, despite I hadn't seen them in so long. I was overseas for the divorce, which I filed for.

And I wont get to see them again until this summer just before I go to my duty station, and a year after that.

I just don't understand why, even knowing this, she still refuses me.

That's obvious, because she wants to hurt you so much she doesn't care about hurting the kids. Go to court and get a long distance parenting agreement put into place as a legally enforceable order. She can't argue with that once the judge signs it, and if she doesn't comply you can file for contempt.

How long ago did you divorce? Did you see them for one month in a year's time, or in 5 year's time? See where I am coming from?

A typical long distance schedule is every other Thanksgiving, a week at Christmas, every or every other Spring Break, and anywhere from 1/2 to 3/4 of the summer.

Why wasn't custody and visitation handled in your divorce?

We divorced 2 years ago. I spent one of those years in Korea, and I brought the boys down here for a month this past summer.

We had a no fault divorce, and there was nothing mentioned either way about the kids...It was stupid on my part, but I really didn't think that she would act this way.
