I am currently in a lease until December and I want to break it early. The reason I want to do this is because the manager and maintance don't do anything.

One of the problems that happened is that someone threw up in the stairwell on the first Saturday in April. My wife called them and told them about it, but it took over an hour for someone to come out and clean it up. All they did then is sprinkle some powder on it to cover up the puke (there was a log of it, it happened on the second floor but landed on the first). They left it that way for over a week then they finally came out and vacuumed it up (they didn't clean the floor). There was a trash can on the floor that got slatter on it and the splatter is still there along with some puke on the stairs that they never touched. Now, when it gets hot, the whole apartment complex stinks.

Another problem is that we had bee's living above our balcony. My wife is extremely allergic to them (she swells up big time). It took them over a month and 4 visits to finally take care of the problem correctly. (They called a pest service instead of using the bee spray from the store). I told them my wife is allergic, but they didn't seem to care.

They also miss most of the appointments they make to fix stuff, which costs me work time. I want to move into an apartment that actually takes care of their tennants problems the first time and the right way.

Is this enough to get me out of my lease without having to pay for the entire lease?

NO those are minor problems next to a ceiling collapse and RATS, biting you at night....

Write a letter to landlord stating you would like to terminate your lease. Try to be as pleasant as possible. Let him know that you would like a resonable amount of time to find a new place. Many landlords are willing to work with a tenant. As a landlord I do not want someone who is unhappy with their living arrangements to be forced to stay in one of my properties. A cooperative attitude can go a long way.

I've had previous problems of the same sort and have had a consultation with a lawyer. If you have proof (e.g. pictures, WRITTEN and dated requests to have the problems fixed, and copies of maintenance reports) you may be able to bring up suit. However, if you have no proof you have no case. The management can deny there was ever a bees nest or can deny there ever was a complaint.
