was charged 3x on credit card, then got bounced fees - help!

i placed an online order. the company charged my debit card 3 different times for the one order. This was on 12-6. I called on 12-7, and was told that the credit would appear in 3-4 days.

3-4 days later - no credit. i called again and was told that there was no credit in the system - 1st rep must have forgotten to do it. it will be done now - give it another 3-4 days.

So finally, on 12-16, the credit finally comes. but due to $107 being charged 3 times - i ended up getting several bounced check fees.

Do i have any recourse in recovering those fees from the online company since they took 10 days to get the overcharge back to me?

You KNEW you didn't have money in your account (regardless of *why*) yet you wrote the checks anyway???
It's against the law to write checks when you know you don't have money in the account to cover it.

Did you ever think that these could have been checks she wrote before she did this transaction???????????????????????????????? :rolleyes:

In theory, maybe. In fact, no.
You would have to be able to show that the damages are directly the result of THEIR errors (and not your improper writing checks). You would have to also show that the damages you incurred were due to THEIR negligence (and not just simple errors). Finally, you would have to do it THEIR 'home' court.
The simple fact is.... it is not worth it to have to try to pursue the less than $100 'damages' you likely incurred.

If you did write the checks before this happened, did you talk to your bank about it? They may be nice and waive the fees. Be very nice and explain the situation. You never know.
