Washington Mutual woes

My husband and I filed for a modification with Washington Mutual of CA in February 2006.

After a lot of paperwork we were accepted by a modification specialist by the name of
Pam... ( we have the last name and her phone number} She called us to let us know that we were accepted and that we would be getting the papers in March 2006. We had to pay a down payment of over 600.00 which would put us current and the next payment would be in May.. we received the papers and a rep from WA came to our house to have my husband and I sign documents..We were then told to have our signatures notarized ..which we did.. we have the mod papers telling us the mortgage payments and what our fees covered which included the taxes for the property..

We then paid the mortgage for May...I have a email setup with WAMU showing that whenever a mortgage payment is made it will go to my email as a paid notification..Of which I had received 3 email alerts.. Next we get a registered letter in the mail saying that we were behind in our payments since Feb 2006 and that a forclosure was in the works... Well my husband then called the default department (Barry.. we have his last name and phone number also) and he called Pam who then cleared up the forclosure ..but admitted the paper work was set up wrong... that was in the beginning of April 2006... My husband then proceeded to leave Barry voice mgs asking them what the problem was..still no answer... Meanwhile we get a letter from WAMU stating that they paid our taxes and we had to pay them back about $200.00 more a month for the next year! Well the taxes are listed in the modification plan that was mailed to us... We were told that sometimes the taxes are included and sometimes not???...

Now we have received ANOTHER foreclosure notice in the mail indicating we have been behind in our payments since March?? What is going on? My husband went to a counceling service to try to get some help but then when the mortgage company was called they ( the person my husband sat with got the persons name) said the down payment we made were for fees...This is not what we were told... We were told by Pam that the downpayment covered the back payment and that we were to start paying in May... we do have receipts for the money sent to WaMu.

With all these class action lawsuits and angry customers against WaMu..and WaMu is doing the very thing to us that is going on in the law suits...how are we going to be able to fight this company?

FINALLY... a legal question.
Answer... with a REALLY good series of WRITTEN communication (stop using the friggin' phone!!!).... or a good attorney.
