purchased a restaurant in hammond indiana in 1996 with one of my companies . 9 month later after extensive rehabe changed the name. one year later [1998] received a trash pickup contract from the trash hauler that was doing the servive when we took over [company a]. i did not signed the contract und the company did not press for signature. the company subsequently kept raising the rates. in 10/2000 received a 56 % lower bid from the competitor company and signed w/ him .now company [a] match the bid but i stayed w/company b. now company a,produced a contract [totaly unbeknown to us of its existence] signed in 1991 w/ a successor clause stipulation. the forwarded contract which we did not signed in 1998 after the name change in 1997 , was ammended internaly by company [a] without our knowledege. company a continues to bill us. back in novemmber 2000 the account retention manager and the sales manager had a buisness lunch w/ us wereby we bargained that they contact company b to inform them that we were not aware of the contract existence and if they would bow out. so far with no avail and that after 2 communique's / papertrail with the account retention specialist and numerous phone calls and in all instances with no reply. we continue being billed and we are searching for the legal venue to stop company a to continue to bill us or find a remedy due to their failure to inform us of a contract existence when change in ownership and name changed occured. and then taken it upon themself to ammend the 1991 contract in 1998 without our knowledge . please advice of a legal remedy to get company a of our backs as we feel that their contract is void .
