Hello, I took my children to the local YMCA for swim lessons this past Friday. I locked my belongings in a locker and had lessons. When i came back to the locker room, I unlocked the locker and began to get my children dressed. My watch at this time was located on the top shelf of the locker, and it was still there. When I went back to get the rest of my belongings from the locker, my watch was gone. Someone had taken it while I was attending to my children. The watch unfortunately is a good watch with a diamond at 12 o'clock. It was purchased for $200 in May 2005.

I have filed a report with the YMCA and with the local police department.

The YMCA personnel have said that there are signs posted that say that they are not responsible for any lost property.

What are my rights here? Do I have any rights to make a claim with the YMCA's insurance company?

No, I have not seen the sign they mention. There is one sign as you enter the woman's locker room offering family locker rooms for families if they want to use them in a different area of the Y. But I am not certain of what else it says. There are NO signs inside the locker room at all. Thanks for your help.

Are you saying that someone took the watch from your unlocked locker?

If the Y has any responsibility, I think they fulfilled it by providing a place where you can lock up your stuff.

It's disappointing that people are dishonest and steal things, but the Y can't be held responsible for the actions of the thief, in my opinion.

You can file a claim ... they almost certainly will reject the claim.

The YMCA is not responsible for the criminal activities of others.

Most likely there is info in the membership material stating they are not responsible for lost or stolen items. You should not have left a valuable piece of jewelry unattended in an unlocked locker.

Almost certainly they tell you not to put it in even a LOCKED locker.
No guarantee of any sort of security is made in those type places.
