My neighbor moved out of his house and put it up for rent. While it was vacant, his furnace failed and caused the pipes to freeze and break. When I woke the next morning and let the dogs out, there was water literally pouring out of the side of his house. I finally was able to contact him and he came and turned it off.
At first he was willing to talk about the amount of damage to my property, but a few days later, he referred me to his insurance company, who has taken the position that they are not willing to cover the damage as they say they are not responsible since it was an accident.
I called him again, and he agreed to review a quote by a reputable landscaper who has provided a quote for $1000 to repair the retaining wall, and remove the dirt and debris and reseed the lawn.
After he received the quote, he has refused any more communication. His insurance company has also refused communication. I recently had a burglary occur and my insurance company is saying that if I file another claim, my premium will rise. Additionally, my deductibe is 1000 anyway, so it really makes no sense to go through my own insurance.
I understand that it was an accident, however, I feel he is lible. He states that there is some law in Colorado that makes him immune because it was an accident.
