Water damage liability!

Our refrigerater developed a leak in the water hose attached to the back it was the size of a pin head.The refrigerator was only few years old when this happened. It leaked water into the neighbors condo bellow . We called in the insurance company and he took pictures of the damage and said they wernt covering it because it was an accident not perposely done. We tried to talk to the neighbor but she slammed the door in our faces. The neighbor got the home owners to pay for the damage and then became treasurer of the association and now the home owners assosiacation is sueing us to get the money back they paid out. Are we liable for the damage? It was an accident beyond our control. :confused:

A: Yes. You caused it.

How is we caused it? We didnt stick the hole in the tube. The fridge wasn't that old. Even the repair man said brand new refregorators have this happen to them. There is no way it can have been prefevented or know you can no its going to happen. it;s not like we had 20 year old fridge that we neglected to take care of.

Okay, if y'all did not cause the damage, then who did?

Check your insurance policy again. If the cause was sudden and accidental it should be covered under your policy. Call a Public Insurance Adjuster or an Attorney for some advice.
Its not uncommon that the company adjusters dont totally understand how their policies work.
