Water leak dispute

What is the name of your state (only U.S. law)? California

I had a leak in the drain trap where the dishwasher drain connect into. All the wood floors, kitchen cabinets have to be replaced. The adjustor said the counter tops would have to be replaced also. This is about a 30K job. It would only leak when the dishwasher was run. Mercury Insurance now says there is something in the policy that says if damage occurs longer then a 7 day period it is not covered. They are contending it happened longer then 7 days and are balking right now. I disagree. There is no way they can prove it was longer then seven days, and I believe it happened during one week otherwise we would have seen the water coming up through the floor. They haven't officailly denied the claim but I know it is coming. What course of action do I have?

$30k in damage from a dishwasher leak in less than 7 days.

It only damaged wood in the kitchen but they will have to replace the entire downstiars, 10K. The counter tops are granite and the adjustor said when the cabinets are removed they can't save the tops, another 8K. Cabinets while only 5 have water damage they can't match them so the entire kitchen must be replaced. It dosen't take much water to do alot of damage.

Most homeowners policies completely deny any type of intermittent water loss, meaning, if it happened more than once, there is no coverage. Allstate probably made a business decision to call that length of time 7 days, or it might be in the policy, but usually that type of damage is not covered at all.
