hi i need help bad! my mother and i sold our house about 6 months ago to move into a better neighborhood. we went through a realtor, and my mother set some guidelines with them. she informed them that she would be taking a few plants with her because her mother had just passed away and she gave the plants to my mom and she wanted to keep them. the realtor said no problem. finally we had a buyer. it was a newleywed couple buying their first home. they came by the house quite often before they bought it, because they were excited about their new home, and they wanted to show their friends. well they had a problem. they had no furniture. my mom told them she would sell them her furniture, it was only 1 year old, and in excellent condition. the couple agreed, and they told my mother they would pay her 500.00 for the furniture in installments. before moving day, my mother had informed them about the plants she wanted to take. they said they knew about it, and to take whatever she wanted out of the yard, and my mother said no, i'm only taking what i said i wanted to take. well that was the end of that conversation and we moved into our new home. 2 months had went by, and no word from the couple about paying for the furniture. my mom called the wife at her work, because she worked for the realtor that we sold our old house through, and she would always say, "next week" well my mom finally got fed up with it, and talked to someone in the legal field. they said to send them a letter informing them that if no money is recieved by a certain date, then the furniture will be picked up. well the husband of the couple came to our house and informed my mom that he had gotten her letter and he wasn't paying for the furniture, because she took plants out of the yard. mom looked in the contract from selling the house, and the realtor did not put it in the contract that plants were being taken. even though the couple knew we were taking them, we knew that it would still have to be in a contract. we called the realtor and told him what was going on, and he said he forgot to put it in the contract and made a big joke about the whole thing. we figured everything was good, and forgot about the whole plant thing. well my mom took the couple to court about the furniture, and won, no more than she walked out of the courtroom, she was given a paper stating they were suing her for breech of contract. saying she took plants, light fixtures and replacements. we went to court over that, and these people just lied the whole time. they told the judge that we took an air conditioner, ceiling fans, trees, and that my mom had been snooping around the property, they even got a neighbor to come in and lie for them as well. they wanted 4500.00 but only got 1600.00 they should have not gotten that. also, they had a lawyer, and we didn't. well, as we thought everything was over, my mom got a phone call saying to come to the police station she was being put under arrest for criminal tresspassing, and stalking, and she needed to come and be booked and she could bail herself out. my mom was in complete shock. the couple has written a report, saying my mom was coming over and going into their yard, and charged her with the tresspassing. the neighbor that had to come into court with them said that my mom had been coming into her driveway and sitting there. and she charged her with stalking. and they said it had happend on sept . 5th. they had no evidence, and my mom was even at work when they said it happend, but she was still arrested and charged with both crimes. she did not do these things!!!!!! we got a lawyer, and he was awful. he didn't even look into the case. mom had to go around and get statements from people saying where she was that day, and that old neighbors had not seen her in that neighborhood since she moved. well, court day came, and our lawyer said he would talk to the d.a. so he did, and said he agreed to 6 months to drop. whatever that is. i told the lawyer that she didn't do anything, so why should she agree to anything, and he got smart and said "do you want it or not!" he said that in that kind of crime, that was a good deal, and i said she didn't do it!!! anyway, my mom agreed because she was tired of going to court, and was tired herself. since all of this has happend, my mom hardly sleeps, we are in major trouble with money, because i was layed off from work, and all the money my mom had put away for bills, went to the bogus lawyer, and bail. is there anyway we can sue these people for false accusations? they have run my mom into the ground all because they did not want to pay her for her furniture. we know for a fact they have both been in jail in the past, they are divorced now, so, as far as the whole plant thing, it just goes to show you they only did it because my mom won the money for the furniture. as far as stalking and criminal tresspassing, we believe they only done it to make it look worse on my mom in court. we really need help. i believe we can get them. my mom just wants her money back, and for them to be exposed for the liers that they are.

wow - this is miserable. I too have been falsely charged with destruction of property and hardly know the woman. I am hoping i have a civil charge against her for false staements to police causing my arrest.

I hope someone posts a response that may help us both.

Long question, but the answer is short and simple.

It appears your mother pled guilty (or no contest) to the charges, and accepted a 6 month probation.

She can not prevail in a civil action, as she has already pled guilty! Time for her to move on with her life.
