We paid $17K for festival VIP package but festival might be a scam

In Oct. of 2016 my wife & I, along with 7 friends, paid $17,000 to XXX XXX for a VIP package for their XX XXX Week festival that they were supposed to be putting on in Sept. 2017 at XXX Ranch in Tennessee. In Feb. 2017 XXX announced that they would no longer be hosting the XXX event because of breach of contract. Since then it has been discovered that L was the owner of XXXX and he had been convicted of fraud & money scams on multiple occasions. In the beginning he offered refunds to everyone that wanted a refund but only issued a few refunds before announcing that the company attorney advised him to stop issuing refunds.

Currently our group is divided on how we can & should proceed. All of the money from our group was given to 1 person who got a certified check (which was the required form of payment by XXX). Some in our group want to hire an attorney now and try to sue XX to get our money back. Others in our group want to wait and see if the event happens. And if it doesn't, they feel we would be better off to join the class action lawsuit that will surely follow.
Since they offered, & paid refunds in the beginning, can we sue and force a refund now?
If we sue now & loose, can we still join the class action suit?
Everyone in our group was under the impression that Ranch was putting on this event, by the way they advertised it. Is Ranch liable in any way?

If you sue, it means you've opted out of the class action lawsuit and won't be able to get into it because, as a plaintiff, your case will have already been adjudicated and the defendant will be able to get you dismissed from the class action.

I suggest you and your friends chip in and hire an attorney and review your options.

Way too complicated to go it alone.
