Well during the inspection we found that the upstairs a/c wasn't cooling as it should. So we added in our inspection contigency that the seller is to have the upstairs a/c unit serviced and repaired.
They showed me an invoice of work that the problem was fixed and said the a/c company would be coming back out to complete the servicing so we closed.
A few weeks later the a/c company comes back out and says the upstairs a/c is in need of repair. In inspecting the earlier work order, it says they serviced the downstairs unit. So essentially we have no proof that the upstairs unit was ever serviced and repaired.
In speaking with the seller's agent, they are saying that the seller thought he was servicing the upstairs unit and since we've closed, it's my responsibility now.
What options do I have? Legally, do I have a case?
