I help operate a webcam chat website that uses a no-cost (free) web chat service. I have it embedded into my website so that users go to my website to use the service, but it's routed through the main webcam site. This is similar to embedding a youtube video.
I have a solid base of users, around 30 that log in throughout the day. I currently have Google Advertising installed on the website which is helping a little with the bandwidth costs. My problem is that the page is operating on my personal domain, and as the website continues to grow I'd like to move it away from there.
I've since registered a domain name that fits the service. I'll call it tokclub.com for the sake of this post. The name of the main webcam service is tokbox.com. I realize these names are similar, but as I'm using tokbox's technology I thought it would fit to include a portion of their name in the URL.
I asked them if this was OK and they talked to their lawyers about it and told me they did not approve and would not license the tokbox name for this purpose. My main question is if I'm in my legal rights to use the name if I offer some kind of disclaimer that I am in no way affiliated with tokbox. I don't want to get sued for using the domain, and I understand that tokbox wants to protect their trademarks and intellectual property, but IMO "tok" isn't exactly infringing on their trademark.
