My wife accidently filled out a form to get a list of bank cd rates from a company (bankcd.com). Even though it stated that the fee was $9.95 for this service, my wife thought it was free and filled out her email address. The company sent her an email with the rates which she received and thought was junk mail and so discarded it. Now a few days later we got an email from bankcd.com asking us for the $9.95. Do we have to pay this? We didn't use their information. Please advise us on what to send to this company. I think it's equivalent to dialing a phone number incorrectly, realizing it was the wrong number and then calling the company and getting credit for the mis-dialed call.

My sense is that you might write and say it was a mistake, their form was misleading, they did not ask for credit card numbers and you thought it was free, and you will not pay, and if they pester you you will complain to the state consumer protection offices and the Federal Trade Commission. I doubt anyone will sue for $10, or even turn it in for collection.
