The custody battle is still going on. Its gotton pretty ugly. The Judge has put my son with his Dad until the final hearing to let them get to know each other. Im not handling it very well.

Question is that until then I have my son on the 1st, 3rd and 5th weekends beginning at 6pm Friday until 6pm Sunday. During Christmas this year I had him from the time he got out of school untill the day after Christmas at noon. He had him until school resumed which was Jan 3rd.

I wasnt sure if Jan 1st was technically the first weekend of the month since it didnt start with a friday, or is Jan 7th-9th the first weekend of the month?

I dont want to go to pick him up today and have his dad tell me no. He has been very ugly during this whole thing all communication between us parents has been lost because he cusses me in front of our son. I just dont want anymore Drama. I just want to see my son.

My calendar for Jan., 2005 shows the first weekend of this month as the 1st & 2nd , the ( second ) weekend as the 8th & 9th , which doesn't reflect the order.
 
In TX and dealing w/the 1st,3rd, & 5th wkds in possession orders, the 1st wkd begins on the first Friday that falls on the 1st or after. If the 1st falls on a Sat. that weekend counts as the 5th weekend.

Ex- for this month Fri.Dec.31st-Sun.Jan.2 was the 5th weekend, Fri. Jan.7-Sun. Jan.9th is the first weekend.

weekend possession begins on Fridays so it is the Friday date that you go by in determining whether it's the 1st or 5th weekend.

According your post your ex had your 5th weekend due to holiday possession superceding regular weekend possession periods. Today, Jan. 7th begins your 1st wkd possession for this month.

I hope this is right, Ive put in a call to my attorney but havent recieved a response yet. This is what I thought but wasnt sure. Thanks for responding.
