weird divorce question.....

I live in ohio and have been married for 8 yrs. We have no children, or own any property together. I want to divorce my husband. I am going to visit a friend in Canada soon, and I wanted to know if it would be possible for me to serve my husband divorce papers while I am in Canada? I want to do it this way to avoid an ugly scene between he and I, and the relatives. Can I find an attorney there to do it, or do I have to find one here in Ohio?Would it be possible to do one of those "do it yourself" divorces, without an attorney? What would be the best way for me to go about it?

My response:

It's all about "jurisdiction".

Ohio has jurisdiction over you, your husband, and any potential divorce. Therefore, you're going to have to file your Petition in the court closest to where you live in Ohio.

If you have an attorney do this for you, the Petition can be served by a process server while you're in Canada. However, at some point you're going to need to come back for the proceedings.

Just make sure he does not have access to any of your personal processions when he is served. With you being away, you might not find anything left when you return.
