What a mess

Stupid family members. My brother was engaged. The two of them built a home together. He put the entire down payment of $25,000 on the home. In addition, many updates were completed to the home - i.e. landcaping, building out a new room, huge home theater, not to mention the engagement ring. They broke up. He completed a quit claim so the mortgage was in her name and an agreement that she would buy him out of the mortgage. She lived in the house for another 1 1/2 years. Then she recently sold the house. The profit on the home was about $38,000. She took all the new appliances , furniture, home theater and ring. My brother is trying to get his due money. She sent a check for $25,000 (note the original down payment on the home) with a note stating that she thought this was fair for the 6 years they were together in the home. He has not cashed the check and is seeking legal council. (There's a special place for people like this). What is he entilted to? Can he place a lien on her new home until this amount is settled? Do they do to court or an arbitrator?
