The other night my daughter was handed a PFA (abuse order) from her husband's lawyer stating that the husband was afraid of his wife and has temp custody of their kids. The hearing is tomorrow. The kids were away with us for a week before this. My daughter went into the house ( she moved somewhere else so he could use the house and the kids would not feel "homeless" ) and he had emptied the place out and while she was there he came in . While she was there he grabbed her arm to try to get the phone away from her ! Then two days later she was served with this paper. She has text messages from her husband threatening to kill himself not once but twice . He has moved into his mothers house , a 3 bdrm twin, that already has two families living there ( his parents and sister and her two children along with 3 dogs and now a puppy that the husband has purchased for the kids)
My question is ? ? What is her chances of getting custody of the kids with this "evidence" she also has pictures of the house before it was emptied out and the way it is now. Him calling her a "skanky whore" as he walks down the walkway taking more things out of the house with his 10 year old behind him telling him to "shut up dad" . Police pull up and tells my husband he can "take what he wants , it's his house " and husband is only the "landlord" but husband can't go in the house to see if any damage has been done.

Your daughter needs to go the hearing. Your husband is NOT allowed to enter the residence even if he owns the house as it is someone else's residence. He is a landlord. Your daughter's husband was allowed to remove property from the home because apparently there is no divorce filed or other court orders preventing him from doing so.
