What are legal rights of school system re home/hospital tutoring

What is the name of your state? Maryland; finishing up my son's Section 504 plan. He has cystic fibrosis. It took 2 meetings before the school would even agree that he had a disability; first request was denied because "his grades are too good." After providing reams of documentation that he was indeed disabled, he was approved for a Section 504 plan. Now we're running into issues with home and hospital tutoring when he misses school because of CF. We were told by the head honcho that 1) "by law" she had 10 days to arrange for tutoring (so if he misses only 2 weeks of school she could theoretically not have to provide a home tutor) ; 2) since he would be hospitalized in another county, that county would make arrangements for in-hospital tutoring and unless he were hospitalized for at least 3 weeks they would not provide in-hospital tutoring; and 3) he had to miss at least 3 weeks of school before she had to arrange for tutoring. Is this true? I find it VERY hard to believe that someone with a documented disability who misses school because of that disability has to be out THREE WEEKS before any tutoring is arranged and if he is hospitalized he will receive NO TUTORING if in for less than three weeks. Any advice, pointing me to the right direction, etc. appreciated.

Who is this "head honcho"? I'm sure you can find someone above him/her. This doesn't sound right at all. Did you contact someone from the Maryland Deptartment of Education?
