I was employed at a fitness club as the general manager as well as a personal trainer and nutritionist, after continued harrassment by another employee which the owners would do nothing about I left this job two days ago.
I also owned two businesses in this gym, a tanning salon and a smoothie bar. The owners agreed to buy me out in Feb 05. They have made no payments since 4-05. Since the agreement was made verbally in 2-05 I have been unable to get him to sign an agreement although he began keeping all monies coming into both businesses 2-01-05. He even leased out the smoothie bar for a short period 6/05-9/05. Since I was employed at the gym I had been trying to work with him on the payments because he said he didn't have the money to pay me for the business and was trying to get a loan to pay me in full. Now that I am no longer employed there I'm a little concerned with what steps to take. Do I have the right to just go in and remove my property from these businesses? He paid about 4000.00 towards the 30,000 purchase price.
Since I am no longer there I can not make sure my property is not damaged or removed without my knowledge. Also am I responsible for someone being injured or burned by the tanning beds since I am technically still the owner?
