I am a tenant in good standing in a multi-unit complex. I have lived in my same apartment for almost two and a half years. In the last 6 months, I have had a family move into the apartment above mine that is so loud that their noise rattles the things hanging on my walls. I have complained to the other tenant, which only causes them to become more loud and obnoxious.
I have complained to my property manager, both verbally and in writing. The last time that I submitted a written complaint, I was left a note that stated that the family upstairs was very tearfully apologetic, and consists of a woman, her 15 year old and a baby and could not POSSIBLY be making the amount of noise that I described. The note then went on to state that my property manager had checked with the neighbor below me and had been told that I too am just that loud and basically that I should thicken my skin and ignore it.
I have come to the point that I would prefer to move out and be rid of the problem than keep arguing over who is loud and who isn't. The neighbors above me now consist of 2 adults and no less than 3 children besides an infant. I have small children and work a full-time job, so I cannot handle being kept awake by stomping and roughhousing above my head at all hours of the day and night.
What are my rights as a tenant? My landlord has told me that I will be responsible for an early termination fee of one month's rent and that I will lose my deposit. I feel as if this isn't fair and have been told that I should inquire about peaceable residence laws.
