hi my name is kyle, me and my girlfreind split up about 2 months ago, we were together almost 2 years, we have a 6 month old, i was there when she was born and till she was about 5 months old, my girlfreind keeps threatening me that she won't let me see her anymore and gonna get me for child support, since we split up i've had her everyother week for a week at a time, payed for everything like diapers wipes, food, formula, and all that stuff, 2 weeks after i left her she had another guy in there already and another one a week after that, she already has a 2 and a half year old and a 1 and a half year old also, she doesn't know the father to her oldest and the father to the middle one comes and get's her oldest and middle child like once a month for the weekend, sometimes twice, i dont' want my daughter goen through what her 2 go through, callen a dozen different guys daddy, i'm the only guy that was there for her other 2, she doesn't have her liscence, lives in a low income apartment, her 2 don't get outside at all, they don't make there doctors appointments, everytime i get my daughter she's hoarse from cryen so much and i'm getten sick of being threatened, does she have more rights than me? can she really take here away that easy? i have a record for underage drinken and traffic violations and she keeps tellen me that's why i won't get custody, is this true? she just lost her job so she's gonna be getten back on welfare, i live with my parents for now, just getten ready to get my liscence back in a week and i have a job lined up already, is she right? can she take her jjust like that? i'm an excellent father, she gets more love here with me and my parents than she could ever get anywhere else? please give me some good news thanx kyleWhat is the name of your state?

First of all, STOP giving her money. If you feel guilty about doing that, then take what money you would be giving her and put it in a bank accout to save until the court decides what is going to happen.

Next, find a local attorney and file for custody/visitation/support and paternity.

There is no proof yet that this child is yours and until that occurs and a court orders support, you don't owe this woman a thing. However, you DO NEED to file for custody.

i haven't given her any money, i just pay for everything when she's here, but does she really have the right to just take her from me right away before even filing for custody, either one of us?

Yep, until the judge says so YOU ARE NOT daddy.

Listen damn it. You are NOT the child's father. You have no legal rights or obligations to this child. The ONLY way you can receive LEGAL rights to this child is to do as I said.

If you want to find out how many times men have said the same thing only to find out the child was not theirs then search this forum.

Until a court says you are the father you are no one to this child.

listen man don't get pissed i'm just tryen to get some information here, and yes the paternity test sais i'm 99.99 percent her father, now if you still say that that and the birth certificate gives me absolutely no rights then i will do what you said well i will do it anyways i am just worried about her not letten me see my daughter for the time it would take to get to court

FIrst, I'm not pissed. I'm trying to wake you up. You have nothing yet and until you get that in your head then you'll never have anything regarding this child.

also, since you didn't mention a paternity test in your first post, how in the hell are we supposed to know that? If it was a private test NOT ordered by the court then it's worthless. If it WAS ordered by the court then you need to follow through.

thank you for your help and yes you did wake me up, i thought since i was there when she was born and my name was on birth certificate and the paternity test done, that she had no more rights than me till we go to court, but you woke me up and thank you much

Fact: MOM IS IN COMPLETE CONTROL
Fact: You need to be adjudicated the father and be given legal rights and responsibilities. You should file as BB said. BB is right. Listen to BB.

Please listen to BB.

This woman doesnt sound like too much of a prize, so I'd try to file for custody, too. At the least, keep a record that you keep her 50% of the time, and you might be able to, if you cant get domicillary custody, get shared parenting. Keep the receipts for what you buy her, to show you are supporting her, but DONT give mom any money.

Go to court, file for custody and child support, a DNA test, etc.
