I am a licensed daycare provider and have a contract that all my parents must sign before I take their child. My problem is that one of my parents left without paying me a two week notice which is in my contract that you give a notice and pay for that notice. what are my legal rights to get the money and can you help me write a letter to keep on file when this happens again to let the parents now that I have a right to be paid and expect to be paid.

My response:

You have a right to sue the parent in Small Claims court for having breached the contract. When you write your letter, merely state: "You have failed to give me two weeks notice pursuant to our written contract you signed on __________. The provision you have breached states: (Quote the entire portion of the contract about Notice). I DEMAND immediate payment in the sum of $_________. If you persist in failing to pay me pursuant to the terms and conditions of the said contract you signed, I will commence a lawsuit against you on or about __________ (complete date). You should seek the advice of an attorney immediately because your rights may be affected."

Send the letter via Certified, Return Receipt. If the parent fails to accept the letter, and it is returned to you, that's okay. DO NOT OPEN THE RETURNED LETTER. Keep it and bring it to court with you, so the judge can open it. Bring all of your proof - - e.g., the signed and written contract, daily sign-in sheets, letters, and everything else.
