What is the name of your state? north carolina .....never married to the mother but had a visitation work ed out and then she just stopped bring her and kept breaking promises to bring her to see me or even meet me there is no reason she should not allow me the right to visit i dont drink or do drugs or have a criminal record worthy of keeping her away from me? i know there are papers you can file but i dont know what to do first.

(North Carolina) i would like to try an go through mediation first and i really dont want to have to hire a lawyer unless that dosent work but how do you get her into mediation?

If paternity hasn't already been legally established, you need to go to your local county courthouse and file for this. You cannot get court-ordered visitation until you're proven to be the father. This will require a DNA test that you (& possibly your g/f) will have to pay for. It may take months to complete. Once your're proven to be the father, you'll get visitation rights - usually a set schedule - and will be ordered to pay child support. You can ask for a mediation conference instead of a court hearing - but it all depends on how your county handles this. Some may not offer mediation services for this. Call the court offices first to inquire about everything. Alot of times they'll say they can't give out legal advice, but other times they will tell you what forms you need to file to get started.

thanks Phnx02 that is very helpful i have already taken a dna test and have the results as well as i have the right form (i think) to submit to the court that really what i need to know is what forms i need i guess the court house says that they cant give legal advice and i should go to the law library.is there a program that had a compilation of forms like pc attorney and lawyer 2002. i have those but they do really give much info on what to file first! :) :eek:

also i would like and idea of how much like a percentage of your pay i can expect to pay in child support for the state of north carolina ...does this vary based on her financial stability,custody terms of the child? if custody is equal who pays child support?

~Most states have an online support calculator that will give you an estimate on how much support will be ordered. Do a google search for "North Carolina Child Support Calculator", that should get you to where you need to be. If custody is equal the parent with the higher income usually pays support so that the child lives in similar financial enviroments when with mom and dad.
