What is the name of your state? Texas/Colorado

About 4 years ago, my boyfriend bought a home in the state of Texas, with his current finance at the time. They lived together in this home for over a year until, and then after a surprising circumstance, he just walked out and left the home to his ex girlfriend and her two young daughters. Now, both of them are on the mortage and on the title of the home. From what I understand, her credit wasn't as great as his.

On our joint account, I can go in and look at his mortage account online with Wells Fargo. Lately, I have noticed she's been getting behind on the mortgage payments and when I looked today, she was a month behind. This has been brought up before, and we didnt have the money to get an attorney, since I was going through a long custody battle with my ex husband. We share a joint account with the same bank that this mortgage is with! I don't know how long it would take for her to get behind before Wells Fargo would pull out our joint funds in our account to pay for that mortgage payment? What are his options of getting out of this pickle that he found himself in? What does he need to do?

All that mess is in TX, the home..mortgage..etc...and we have currently moved to the state of Colorado. Can we get an attorney in our current state or do we have to get one from Texas?

Any advice would be appreciated. Thank you

He needs to make certain that the payments for which he is legally liable are paid on time EVERY month, if she has not paid them, else his credit will be ruined AND his borrowing ability for the future impacted. Leaving the relationship has NO BEARING on his responsibility to the LENDER.

He must also file for partition if she will not sell or refi him off the loan.

THis is another reason home purchases should NOT be done between unmarried parties without a partnership or other operating agreement in place FIRST.
