What is the name of your state (only U.S. law)? CA
My son just turned 18 in Sept. and had a baby with his girlfriend 13 months ago in Sept. 2008. The girlfriend will be 17 in Jan. 2010. My son has been in the baby's life constantly getting up in the middle of the night to make bottles, etc. It has been an equal partnership. The just broke up 2 weeks ago and are sharing custody, 2 days on, etc. My question is: Does the father have any rights? Can she take his child away from him or start refusing to let him see him? Do we as grandparents have any rights?

You son needs to file to establish paternity (if that hasn't been done already), custody and/or visitation - before this happens Mom does not have to allow visitation of any sort.

You have no inherent rights as grandparents; once custody and visitation are decided you can see the child during your son's time.

You need to read the California Rape Laws. Now.

Both of them were underage at the time of conception. After looking at the laws, it seems to really deal with when ONE of the parties if 18 or over.

Cuz if you liked it then you should have put a ring on it

It does not matter that both were underage at conception, charges can still be made. And, frankly,because the way the law is written it is most likely that the boy will be charged (read PC261.5). It is a misdemeanor if the act was not forced.

Yes, the father has some rights. But, it will take a court to enforce those rights.

No, mom cannot prevent father from having visitation. Withholding the child from the father could, potentially, be seen as child stealing - a crime, under the right circumstances. However, without a court order, it could get dicey. The daddy needs to file for custody or for visitation.

And, no, the grandparents have no legal right by virtue of being grandparents.

The mother will be 17 in January 2010. The child will be 16 months old in January 2010. That means that the child was born when the mother was 15 and 5 months old when the child was born, and 14 and 8 months when the child was concieved. Your son was 18 in September, so he was just 17 when the child was born, and was 16 when the child was concieved. What was your son doing dating a 14 year old? :eek:

Lots of 16 year olds date 14 year olds. That age group goes to school together. It is not that far off the mark.

In my area 14 year olds are still in middle school and 16 year olds are in high school...so that is where my mind was going.

Most freshman in high school are 14 at least at beginning of school year and most juniors 16 so its very likely they will date. Shoot I know when I was a freshman I "dated" Juniors.
